Information note for british nationals with the right of permanent residence and their family members
(Scope of persons affected by Brexit)
Background
The United Kingdom of Great Britain and Northern
Ireland left the European Union at midnight on 31 January 2020. Persons
affected, i.e., who were holders of a registration certificate, a permanent
residence card for EEA nationals as citizens of the United Kingdom, as well as
holders of a residence card or a permanent residence card issued to
third-country national family members of a citizen of the United
Kingdom were issued a national permanent
residence permit.
From 2024, based on the new rules on aliens policing, national permanent
residence permits may be extended under the name of national residence card.
Key information for
holders of a valid national permanent residence permit/national residence card
1. If a citizen of the United Kingdom has a child born in Hungary, a national
residence card must be issued to the child after the birth has been registered.
2. The national residence card/national
permanent residence permit shall be withdrawn
by the aliens policing authority if the citizen of the United Kingdom or the
third-country national family member of a citizen of the United Kingdom
a) left the territory of Hungary for a
period exceeding five consecutive years,
b) poses a threat to public safety or
national security of Hungary,
c) has been expelled or an entry and
residence ban has been issued in relation to him/her,
or
d) requests the withdrawal of the national
residence card.
3. The national residence card/national permanent
residence permit of a third-country national family member of a citizen of the United
Kingdom will be withdrawn by the aliens
policing authority if the national residence card/national permanent residence
permit of the citizen of the United Kingdom has been withdrawn, unless the
family member meets the conditions under general rules on national residence
cards, except in case of Hungary's national interest.
4. If your valid national residence
card/national permanent residence permit is lost, stolen, or damaged, you are
required to submit an application for the substitution
of the document via the Enter Hungary electronic platform (https://enterhungary.gov.hu/eh/?en), the fee of the procedure is currently HUF
20 000.
5. In case of name changes, after the change
of the British passport, an application for the replacement of the national permanent residence permit/national
residence card via the Enter Hungary electronic platform (https://enterhungary.gov.hu/eh/?en) is also required to be submitted, the fee
of the procedure is currently HUF 20 000.
6. In case you intend to leave the
territory of Hungary permanently, please return the national permanent
residence permit/national residence card to NDGAP’s competent client service
office as per your place of residence, (https://oif.gov.hu/regional-offices), by way of post or hand it in at any
Hungarian diplomatic mission.
Extension
of a national permanent residence permit
In principle, the extension of the national
residence permit documents issued for beneficiaries of the Withdrawal Agreement
in 2021 for a period of 5 years is due
in 2026. The new national residence
cards will be issued for a period of 10 years.
Applications for the extension of a national
residence card can only be submitted via the Enter Hungary electronic platform (https://enterhungary.gov.hu/eh/?en). The procedure is subject to a fee (which
is currently HUF 20 000 / an application for an extension). In addition to
the electronically generated form, a photograph and a, complete copy of the applicant’s
valid passport without certification or translation must be uploaded. Please
note that the form generated by the system is to be printed and signed by the
applicant, and then attached via the Enter Hungary platform after signing.
After completing payment of the fee electronically, following a notification
from the authority, the applicant is required to appear at NDGAP’s competent
client service office as per his/her place of residence (https://oif.gov.hu/regional-offices) for the purpose of fingerprinting.
Pursuant to rules on beneficiaries of the
Withdrawal Agreement, assessment of the conditions on means of subsistence,
entitlement to healthcare, or state of health is still not required. Applicants
do not need to make any declarations in regard to these.
Please submit your application 3 months before the date of expiry of
your previous national permanent residence permit. Additionally, please note
that your right of residence for an indefinite period does not expire when your
residence permit expires. However, in NDGAP’s opinion, a valid national
residence card and a valid personal identification card issued by a government
office are essential for a daily life in Hungary.

Time period for procedural administration
of an extension is 21 days.
If necessary, it is possible to request an official certificate stating the
duration of your the legal status in Hungary and that your application for the
extension of your national residence card is pending. As a general rule, the
application can be submitted via ePaper Services, and the related fee is HUF 4 000.
NDGAP does not require any official certificates for its own procedures.
Please be advised, that the renewal of a
personal identification card issued by the Hungarian authorities is available
at any government office for holders of a new national residence document.

Third-country national family members of citizens
of the United Kingdom legally residing in Hungary may also granted a national
residence card if their family relationship with the respective citizen of the
United Kingdom was established before 1 January 2021, and exists at the time of
submitting the application for a national residence card. The application may
be submitted in the same way as for British nationals.
