Application for payment in installments in the event of receiving a public order fine
The authority may accept payment in instalments on the basis of a
substantiated application submitted by the employer via the electronic aliens
policing case initiation interface, before the last day of the deadline for
payment. The application is free of charge.
The application for payment in instalments must be submitted to the
regional directorate which acted in the first instance procedure and will be
examined by this regional directorate within 8 days. One application for
payment in instalments may be granted per a year; payment in instalments is
limited to a maximum of twelve monthly instalments.
Payment in instalments shall be granted if the difficulty of payment
a) is beyond the employer's control or the employer has acted in a way
which (s)he could reasonably be expected to have acted in order to avoid it,
b) is of a temporary nature and the subsequent payment of the public
order fine is likely; and
c) the employer has not previously been subject to a public order fine
under aliens policing legislation.
In case of an employer who is a natural person, payment in instalments
may be granted without prejudice to point (a) if the employer proves or is
likely to prove that the immediate or lump-sum payment of the public order fine
would impose a heavy burden on his/her family, income, property and social
circumstances.
The deadline for payment of
the first instalment shall be 20 days from the date on which the decision
granting the payment in instalments becomes final.
An appeal against a decision of refusal on an application for payment in
instalments shall be submitted within 8 days and a decision shall be taken
within 15 days.
To appeals the general rules on appeals shall apply and second instance
decisions shall not be subject to appeal.
The immigration authority shall terminate the procedure if the employer fails to make a statement, provide the requested information, submit the requested documents, and the application cannot be examined without the employer complying with the request.
